1. Does my Texas business need workers compensation insurance?

Texas employers, except for governmental entities and construction contracts for governmental entities, may choose whether or not to possess workers compensation insurance.Employers choosing not to obtain workers' compensation insurance coverage are considered "non-subscriber," and must notify their employees and the Texas Division that you do not have workers' compensation insurance. However, if you do decide to become a subscriber of workers compensation insurance,various laws require employers to post notices at the workplace.

2. Are there any exemptions in Texas for workers compensation insurance?

Since carrying workers copmensation insurance is optional in Texas there are no exemptions for workers compensation coverage.

3. Does Texas workers compensation law have specific requirements for sub-contractors/contractors and sole proprietors?

Again, since carrying workers compensation insurance is not compulsory, there is no need to dilineate any differences. Except for sub-contractors/contractors who engage in contracts with government and public entities.
